AU applies for informal mediation
Today AU sent a letter to AUFA, indicating their displeasure in the language used at the bargaining table this past Monday, that the language violated company policy, and that that AUFA should not have endorsed this choice of language. AU then stated they were applying for informal mediation to ensure the progression of bargaining. Informal mediation is an optional process in bargaining where either party can request a mediator to help further negotiations. This is not a required step in the process of escalating to work stoppage, and does not replace the requirement to engage in formal mediation prior to a strike vote.
We believe context has been intentionally overlooked in this letter. In short, AUFA proposed language be added affirming gender and sexuality in Article 26, and AU repeatedly stated they did not “see the need” to add inclusive language on gender and sexuality, which would commit to recruitment, retention, and promotion of 2SLBGTQ+ staff members. This response was degrading and directly harmful to queer members of AUFA’s bargaining team, who had to listen. AU has refused to admit to this behaviour or acknowledge harm done and instead has framed AUFA as the unreasonable party for swearing.
Within the context, we believe this letter is an example of the DARVO (Deny, Attack, Reverse Victim, and Offender) phenomenon.
A common ploy of employers is to enforce decorum from above. Being sworn at is unpleasant. Being told there’s “no need” for language which protects your humanity is disgusting. Decorum in such discussions is a trap to grant the employer power over us. Bargaining is not governed by AU’s policies, which would grant the employer an unfair advantage in negotiations. Both sides are bound by the Labour Relations Code, which does not bar swearing.
The entire AUFA bargaining team collaborated on Monday’s blog post immediately after the altercation. We are happy for AU to specify any inaccuracies so that we can speak to them. We remain concerned that AU continues to withhold a monetary response to our counteroffer and continues to decline negotiations on de-designation, relocation, gender and sexuality, equity, and surveillance.
